Wells Fargo lost a preliminary injunction hearing against pop-up purveyor WhenU. The court ruled that “The fact that some WhenU advertisements appear on a computer screen at the same time (the) plaintiffs’ Web pages are visible in a separate window does not constitute a use in commerce of the plaintiffs’ marks.”

New virus attack uses PayPal to gain access
The latest MiMail worm is disguised as a message from PayPal. I got one of these e-mails yesterday, and my antivirus program quarantined it immediately. If the e-mail makes it past your AV, don’t open it.
